GUAVA RENTALS AGREEMENT, WAIVER & RELEASE OF LIABILITY
This Bicycle Rental Agreement and Release of Liability (“Agreement”) is entered into between GRADANT SL (operating as “Guava Rentals”), holder of Tax ID B67814616, with registered business address at Carrer de l’Alcalde Miralles, 7 Barcelona 08017 and the individual completing this booking (“Renter”).
- Equipment Condition, Pre-Rental Inspection & Security Deposit
1.1 Equipment Handover: The Renter acknowledges receiving the bicycle(s) and associated accessories (helmets, pedals, repair kits, chargers, GPS mounts) in fully operational and safe riding condition.
1.2 Inspection Protocol: The Renter agrees to inspect the bicycle alongside Guava Rentals staff prior to departure and confirm any pre-existing cosmetic or mechanical defects.
1.3 Security Deposit: A mandatory security deposit or credit card pre-authorization of €300 per bicycle is required prior to equipment release. Guava Rentals reserves the right to charge the Renter’s credit card for any damages, missing items, unreturned equipment, or late fees.
- Theft, Loss, and Damage Responsibility
2.1 Renter Liability: The Renter assumes full financial responsibility for any physical damage, loss, or theft of the equipment from the moment of pickup until it is officially returned to the Guava Girona Shop.
2.2 Theft & Police Report: In the event of theft, the Renter must immediately notify Guava Rentals and file a formal police report (Denuncia) with local law enforcement (Mossos d’Esquadra / PolicĂa Local) within 24 hours, providing a copy of the official police report to the Company.
2.3 Replacement Value: Theft or total destruction of the bicycle will result in the Renter being charged the full Manufacturer’s Suggested Retail Price (MSRP) of the bicycle and installed components.
- Cancellations, Refunds & Late Returns
3.1 Cancellation Policy:
Cancellations made 48 hours or more prior to the scheduled pickup time are eligible for a 100% refund (minus payment processing fees).
Cancellations made less than 48 hours before the scheduled pickup time are strictly non-refundable.
3.2 Late Returns: Unannounced late returns disrupt subsequent bookings. Late returns will be charged at a rate of €25/hour, or the full daily rental rate if delayed by more than 2 hours without prior written consent.
- Safety Rules, Traffic Laws & Prohibited Use
4.1 Mandatory Helmet Use: The Renter agrees to wear an approved cycling helmet at all times while operating the bicycle.
4.2 Compliance with Traffic Laws: The Renter agrees to strictly obey all Spanish national (DGT) and Catalan (Servei CatalĂ de TrĂ nsit) road safety laws and traffic regulations.
4.3 Prohibited Activities: The equipment shall NOT be used:
Under the influence of alcohol, drugs, or impairing medication.
For official racing, competitive events, extreme downhill riding, or commercial use, unless explicitly authorized in writing by Guava Rentals.
By any third party other than the designated Renter.
- Exclusion of Personal Health, Accident & Liability Insurance
5.1 No Personal Medical Coverage: Guava Rentals does NOT provide personal medical, health, travel, or third-party personal liability insurance for the Renter.
5.2 Insurance Obligation: The Renter is solely responsible for procuring their own comprehensive medical travel insurance that explicitly covers cycling activities in Spain.
- Assumption of Risk & Release of Liability
6.1 Inherent Risks: The Renter acknowledges that cycling, particularly gravel and off-road riding, involves inherent hazards including terrain obstacles, traffic collisions, equipment failure, and environmental conditions, which may result in severe physical injury, permanent disability, or death.
6.2 Liability Release: The Renter voluntarily assumes all risks associated with the rental and explicitly releases, waives, and discharges GRADANT SL, its directors, employees, and agents from any claims, suits, or financial liabilities for personal injury, illness, death, or property damage arising out of or connected to the rental period.
